Fernanda Stefani Araujo

DIRECTOR

Fernanda qualified as a Solicitor of England and Wales with Higher Rights of Audience. She can appear before the High Court, Court of Appeal, Supreme Court and other civil courts. She is an Avvocato Stabilito in Italy, registered with the Milan Bar. Fernanda is also qualified as a Solicitor in Ireland.

She is specialised in Family Law, Immigration, Mental Health and Court of Protection work. She is Mental Health Panel Accredited by the Law Society.

She regularly represents Italian, Spanish and Brazilian clients living in London with their cross-border and English law matters.

Fernanda trained in a Legal 500 law firm and has over 8 years experience in Civil Litigation. Fernanda is a robust litigator and regularly conducts her own advocacy. She appears before the High Courts to fight for her client's rights. She represents clients in high profile Divorce and Child proceedings in the Family Court. She is specialised in parental custody and contact proceedings with a cross-border element.

As with all litigious matters, Fernanda is a robust litigator and negotiator. She regularly settles claims through extensive negotiations, mediation, and conciliation. She works hard to achieve the best possible outcome for her clients.

Family & Child Law

She successfully defended parental alienation claims, settled lump sums for child maintenance from wealthy and celebrity parents, represented clients in international maintenance applications, divorce and cross-border child arrangement applications. Fernanda has successfully applied for leave to remove for relocation abroad.

Fernanda is specialised in assisting her clients with international child relocation, child arrangements, child abduction, non-molestation orders, divorce, pre and post-nuptial agreements.

Court of Protection

In the Court of Protection, she had the following recent successful outcomes:

  • GB (by his litigation friend PB) v London Borough of Harrow (2021) - Fernanda successfully represented GB in these S21A proceedings. GB was found to have capacity to decide where to live and therefore Deprivation of Liberty and Safeguards was rescinded and GB was allowed to return home.

  • JBG (by his litigation friend the Official Solicitor) v Essex County Council & others (2022) - Fernanda represented JBG in s21A and s16 proceedings to challenge his placement in the care home. JBG was successfully moved into a supported living placement which was less restrictive, and which improved his quality of life.

  • MG (by his litigation friend the Official Solicitor) v London Borough of Harrow (2022) - Fernanda represented MG in his s21A challenge against his placement in a care home. MG was moved into a supported living placement which was less restrictive and which improved his quality of life.

  • MM (by his litigation friend the Official Solicitor) v London Borough of Enfield (2022) - Fernanda represented MM in his s21A challenge against his placement in a care home. MM was moved into a supported living placement which was less restrictive and which improved his quality of life.

  • PL (by his litigation friend the Official Solicitor) v London Borough of Harrow (2023) - Fernanda was instructed by the Official Solicitor in a s21A MCA 2005 to represent P in an application to the Court of Protection. P wished to return to live at home with his family, who fully supported him. P successfully returned to live at home after many years in a care home.

  • BG (by her litigation friend the Official Solicitor) v HCC (2023) - P was able to obtain a trial home.

  • MG (by her litigation friend the Official Solicitor) v London Borough of Harrow (2024) - P was able to obtain a trial home.

 

She successfully obtained an interim and final order against the Government Legal Services in London.

Immigration
 

She successfully obtained British citizenship for my client who did not meet the criteria of Residence in the UK during the last 12 months. She was out of the UK for more than 10 months in the last 12 months due to special circumstances. The Home Office accepted her evidence and granted citizenship using their discretionary powers. 

She successfully assisted clients settling in the UK via different immigration routes.

  • Achieved Mental Health Panel Membership in July 2019

  • Qualified as a Solicitor on 2 September 2019

  • Qualified as an Avvocato Stabilito in Italy in May 2020

  • Obtained Civil Higher Rights of Audience in February 2021

  • Fernanda is a member of the Milan Bar in Italy

  • Accredited Legal Representative by the Law Society in Mental Capacity
